The issue of worker misclassification, where workers are intentionally classified as independent contractors rather than as employees, has been a significant problem in New Jersey and throughout the nation for over 20 years and continues to grow. Employers often seek to classify their workers as “independent contractors” in order to reduce their payroll costs and avoid a host of pro-labor provisions that apply to employees (such as minimum wage, pension plan and health care insurance eligibility and overtime), but not to independent contractors. The practice also results in a significant loss in tax revenue to the state government, as well as lost payments into critical worker protection funds such as unemployment insurance and workers compensation.
S-4204 (sponsored by Senate President Sweeney) & A-5936 (sponsored by Assemblymen Joe Egan and Wayne DeAngelo) seeks to reform this broken system.
